We are thrilled to be ahead of our post-acquisition development schedule for our LAW and EDA products because that means we can accelerate the automation and integration of our complete software portfolio to increase customer choices for eDiscovery ingestion, processing, and review.

eDiscovery Expert Brett Burney Reviews CloudNine Platform

CloudNine – Competitively Priced Cloud-Based Platform for Data Processing, Review, and Production Supported by a Full Professional Services Portfolio

An eDiscovery Platform Review by Brett Burney*

Backed by a strong history of litigation services, the CloudNine platform is an easy-to-use choice for processing, reviewing, and producing the electronic data you collect from your client or an opposing party. CloudNine has developed a “4S” focus on speed, simplicity, security, and services.

“CloudNine platform is an easy-to-use choice for processing, reviewing, and producing the electronic data you collect from your client or an opposing party.”

Uploading & Processing Data

Although the entire CloudNine platform is accessible via a web browser, you’ll need to download the “Discovery Client” software in order to upload data to the platform. The software is Windows-only, but Mac users have successfully used the software through Windows virtualization software (e.g. Parallels www. parallels.com).

The software download feels like an unnecessary step – other platforms just let you upload files directly through the browser. But the extra task actually provides an ingenious opportunity to cull out extraneous digital junk that you don’t even need or want uploaded into the review database. If you don’t take advantage of this, you’re wasting time and racking up unnecessary expenses. Plus, the desktop application offers more robust features and an upload won’t get interrupted if you happen to close your web browser tab.

How do you receive data from clients? Do they send USB thumb drives or external hard drives which they’ve stuffed full with all the data they think you’ll need? Make a working copy of the files on to your computer or server, and then launch the CloudNine Discovery Client software and point it to that folder. The software scans the folder, and you get to put checkmarks on only the files that you need. You should UN-check any computer system files, or maybe you don’t want to upload their iTunes music collection, or you don’t want to look at their sales spreadsheets. You can always go back and upload those files later if you discover you need them.

The Discovery Client software uploads your selected data to CloudNine and starts the data processing stage where metadata is extracted, text files are created, hash files are generated, and HTML renders are completed. CloudNine also generates an EDA report (early data assessment) so you see how much data you’ve loaded, how many messages, families, file types, etc. that you’ll be reviewing.

Analytics & Keywords

But there’s still some investigative work you can do on your documents before you just dive into the first document in the list. Open the Analytics panel in CloudNine and click the “Project Statistics” to get a big picture of the size of the data you’re looking at, the number of pages/documents, average pages per document, etc.

Next you can look at the “Document Keywords” listing out all the occurrences of each word found in your files. This could be a little overwhelming, but handy info if there’s a word or phrase on which your case hinges, or you simply just want to see the frequency of certain words.

CloudNine also presents you with a collection of “Conceptual Keywords” that gives you a sense of the major themes detected in the documents and files. If nothing else, this is a good jumping-off place to determine if these files have the topics you’re targeting.

The Analytics box also reveals all the domains pulled from the emails (EML, MSG, or PST files) that you’ve uploaded.

All of these facets of your data collection can be accessed in the “Filtering” section of CloudNine so you can more precisely cull out certain documents or files that you don’t need to see initially. For example, you can filter out any emails with domains from @ espn.com or @nytimes.com since sports scores and news headlines are probably not going to be relevant to your matter. You can also filter out by file type, or get rid of any duplicate files. You’re not deleting any of these files, you’re just [digitally] setting them aside so you can focus on what’s most important first.

“CloudNine also presents you with a collection of “Conceptual Keywords” that gives you a sense of the major themes detected in the documents and files. If nothing else, this is a good jumping-off place to determine if these files have the topics you’re targeting.”

Searching

Searching in CloudNine is easy, whether you want to search the content of every single file, or you want to narrow down your search to a specific field – such as only searching the From or To or CC lines of an email message. When you search the full text of your files, the words are highlighted in the Text and HTML views so they jump right out.

Click “Recent Searches” to view your search history, or save a search to run it again later.

Viewing Documents

CloudNine has a unique “Vertical Document List View” that shows the document on the left side of your screen, a column in the middle with a file list, and a panel on the right showing available tags and all the metadata associated with the selected file. This is how most folks will use CloudNine once you’re ready to read through documents.

CloudNine also offers a “Native Tree View” that shows the folders of how the original documents were stored and organized. For example, if your client just copied folders from their server and sent that to you, this Native Tree View will show you all of the folders and sub-folders mirroring how your client stored their files. If your client sent a PST file, the Native Tree View shows you the same folders and sub-folders that they see in their Microsoft Outlook inbox. This view is fantastic because you get to see exactly how your client stored their files, which is helpful when you’re conversing with your client on where and how they stored certain files.

If you have a dual-monitor, you’ll appreciate the “Table View” where one monitor can show you the document while the other monitor displays all the document’s metadata.

Document Exports & Productions

There are a host of options for exporting and producing files out of CloudNine once they’ve all been reviewed and tagged for relevancy and privilege. An excellent export wizard walks you through the process of selecting what you need to export: native files, images, OCR, load files, etc. You also have options for Bates stamping files and otherwise labeling them.

You’ll receive an email once the production is complete so that you can download it off the system and distribute it to the waiting parties.

Pricing

CloudNine offers some of the most competitive pricing in the industry starting at $35 per GB per month. That can go down to $12 per GB per month if you have the volume to support that pricing structure. Additional services will add a few dollars to the price.

Always check CloudNine’s website and contact them for up to date info.

Who Is CloudNine?

CloudNine has been around since 2002 headquartered in Houston, Texas. The company started out primarily as a litigation services company, but their main focus today is the CloudNine, cloud-based platform for data processing, review, and production. But they still remain a full-service shop to support their platform and assist you with any of your eDiscovery related needs.

Why You Should Consider CloudNine…

  • An included Litigation Hold tool lets you email notifications and track acknowledgments – much better than manually tracking via Outlook.
  • You can sign up for CloudNine for free without a credit card and load as much data as you want for a 30-day trial. It’s an excellent way to test out the system.
  • CloudNine offers a protected cloud security infrastructure vs. a general public cloud which provides CloudNine more control and access to their servers depending on the needs of clients.
  • If you use Relativity, also check out their Outpost for Relativity service that can streamline the ingestion of data into Relativity saving you buckets of time.

eDiscovery Expert Tom O’Connor Reviews CloudNine Platform

What I Like About CloudNine

An eDiscovery Platform Review by Tom O’Connor*

Introduction

In my 30 plus years of experience as a consultant, author, and speaker in the field of automated litigation support systems, I’ve used almost every software program deployed for the litigation market. And I’ve also reviewed many them, beginning with my days in the 80’s working with the late Dick Robbins and eventually, after his untimely death, taking over the writing of his book The Automated Law Firm (ALF).

If I were rating CloudNine on the combined ALF scoring system, it would get a 9.9 out of 10. (see the rating chart at the end of this review).  I love this product and I’ll tell you why but before I do I’ll give some background on the software and its parent company, followed by a synopsis of my review findings and finally a little deeper look at some of the specific features.

Also, I should note that while I have done work as a consultant for CloudNine, the observations in this review reflect my professional opinion as one who has used and advised clients on the use of similar tools for eDiscovery and may or may not be those of the CloudNine Team.

General Information

  • Platform Category:  CloudNine is an eDiscovery product in the Cloud Platform category.
  • Platform Description: CloudNine is an integrated, automated proprietary software offering which allows users to immediately upload, review, and produce electronic documents.
  • Platform Technology: CloudNine is a secure, web-accessible, SaaS-delivered offering that allows immediate use of ESI without additional downloads or implementation steps.
  • Company Providing Platform: CloudNine is owned by the company of the same name which was founded in 2002. Based in Houston, Texas, CloudNine is a legal intelligence technology company with deep expertise in the analysis, processing, and review of electronically stored information (ESI).

What I like most about CloudNine is its ease of use. A new user can literally login, set up an account, point to a set of data and begin working within 5 minutes.  The free 30-day account sign-up combined with the automatic ingestion, processing, and conversion into a usable format for review make this the easiest program to set up and use I have ever come across.

Additionally, that usability makes CloudNine an effective tool for a variety of legal tasks. In addition to law firms and legal departments, CloudNine can also be used by businesses and corporate departments as diverse as Human Resources, Finance, Compliance and IT to handle tasks ranging from 2nd requests to internal investigations and even audits.

Also important is the transparent and flexible pricing (more on that below) which means CloudNine is within reach of not just large firms and corporate legal departments but also small firms and even solo practitioners.

Finally, when I do a software review I’m often asked to describe what I think are the best-kept secrets about the product.  I don’t think the following are secrets per se because the people at CloudNine do discuss them. Rather, I like to think of them as observations from the 40,000-foot flight level which sometimes get overlooked because we are busy discussing features at the 12,000-foot level.

  • Predictable Pricing. Once you sign up and a select a plan, the pricing is given to you. That pricing is based on data volume, with unlimited users. No additional fees, module downloads or other hidden costs.
  • Outpost for Relativity. An automated data loading service for Relativity that automatically ingests and loads data into Relativity based on your specified criteria. It will collect, filter, cull, and tag data prior to moving it into Relativity and can even migrate legacy data from alternative eDiscovery platforms into Relativity.
  • Free Early Data Assessment (EDA). Before the meter starts running on your collection, you get a comprehensive view of the content and context of your data.
This free EDA service helps you begin to accurately estimate discovery scope and cost, all at no monetary cost.

  • New Targeted Preservation and Collection capability. This cloud-based wizard guided capability simplifies and automates data preservation and collection for corporate legal and IT professionals and is available immediately at no incremental cost as part of the CloudNine eDiscovery Platform.

  • CloudNine also offers a complete portfolio of eDiscovery professional services including computer forensics, managed services, managed review, and eDiscovery consulting. These services are all offered at a reasonable cost if you need them.

Feature Overview

Integration

As mentioned above, CloudNine is a totally integrated product which offers tasks across the entire range of then EDRM from Collection and Preservation to Ingestion, Processing, Review, and Production.

Automation of Processes

The CloudNine Legal (eDiscovery) Platform gives customers a SaaS solution that automates the ingestion, processing, review, and production of data.

  • File Preservation Automation allows users to establish a rules-based identification of files that may need to be preserved for audits, investigations, or litigation.
  • Collection Automation takes files identified for preservation and collects them into a user designated repository. This preservation repository of collected files can then be assessed and evaluated within the CloudNine Data Discovery Platform or moved into the CloudNine Legal Discovery Platform for policy, regulatory, or legal-driven review.
  • Ingestion and Processing Automation allows users to upload data to a secure online repository in a private and protected cloud environment and have that data automatically converted into a usable format for review.
  • Review Automation allows users to use advanced analytics and technology-assisted review to assess, review, and analyze data.
  • Production Automation gives users the ability to create precision productions and privilege logs that are exportable into almost any form. This capability can be used at any point after data upload. into the CloudNine Legal (eDiscovery) Platform.
  • Ongoing Preservation Automation allows data to be stored in a protected cloud data center infrastructure.

Analytics

Standard analytics, such as dupe identification, domain categorization, and email timeline generation, are included in CloudNine processing.  Additional analytics, including TAR functionality (clustering, near dupe and predictive coding) is available for an additional fee.

Review

CloudNine allows reviews to begin within minutes of data upload. A full-featured review tool with advanced search and analytics combined with an intuitive interface allows users to quickly and efficiently assess, review, and analyze documents.

Production

CloudNine’s fully integrated production features allow the creation of detailed productions and privilege logs which can be exported into almost any format. While typically used at the completion of a project, CloudNine productions can be generated at any point after data is uploaded.

Platform Implementation and Utilization

The CloudNine ease of set up and use provides an appropriateness and completeness of capability that makes an ideal solution for firms of all sizes, corporate legal departments, and even litigation service providers.

Possible use case scenarios include a wide variety of information technology, business, and legal initiatives including:

  • Information Governance
  • Cybersecurity
  • Internal Threat Investigations
  • Legal Hold
  • Electronic Discovery

Platform Security

CloudNine owns, operates, and manages a unique private protected cloud data center infrastructure in partnership with CyrusOne. Within this infrastructure, the CloudNine hardware, storage, and network are dedicated to the CloudNine application and complies with industry standards including:

  • FISMA Compliance
  • SSAE 16 Type II Audit (Completed)
  • HIPAA Compliance
  • ISO 27001 Compliance
  • PCI DSS Compliance
  • CSA Security, Trust & Assurance Registry
  • EU-U.S. Privacy Shield Framework
  • Swiss-U.S. Privacy Shield Framework

This approach is different from the completely public cloud approaches used by most eDiscovery vendors and it provides the benefits, efficiencies, and economies of scale of a public cloud infrastructure with the additional security of a protected and private cloud environment.

CloudNine is also on target to be compliant with the EU General Data Protection Regulation (GDPR) by the effective date of the new regulation, May 25, 2018.

Platform Pricing

CloudNine pricing can be based per project or by a subscription model of varying time frames. Regardless of the eventual choice, there is a free trial period which allows an immediate start to begin work on a project. CloudNine also publishes its pricing publicly and this transparent pricing can be viewed on the CloudNine website.

Platform Support

CloudNine provides free training and support, including an extensive online user guide, knowledgebase, and training videos.

Features I Would Like To See Added

Many readers are undoubtedly saying to themselves, “Come on Tom, isn’t there something about this product you don’t like?”  Not exactly but there are some features I would like to see added and they are:

  1. Ability to review the full-text index: invaluable feature for a variety of search functions including Q/A.
  2. Load and search audio & video files. Searching the files themselves would require outside technology but searching the metadata would be a great start.
  3. Directly download excerpts from social media sites.
  4. More customization functionality (e.g., change folders on the fly). I believe this is on the development “roadmap”.
  5. Specific transcript management functionality. Transcript searching has become the Lost City of Gold in all lit support software.
  6. A simple outliner like a lite version of the old Lotus Organizer or CaseMap.
  7. XML “load file” capability. CloudNine can export to XML but import but would be useful as well.
  8. Presentation mode for use in court. CloudNine can currently export to a popular trial presentation software application but a simple presentation mode would be extremely helpful for meetings or unforeseen requests by the Court.
  9. Easier bulk printing/TIFF generation. CloudNine does have the implementation of this feature planned by mid-year.
  10. Full tablet functionality. Technically available now, just not officially supported, this is a feature most litigators would applaud.
  11. Basic case management capability. Not really within the scope of the application but an outpost link similar to the Relativity outpost would be a major bonus for firms working in complex litigation, class action or MDL’s.

 Conclusion

As I said above, I love this product. It’s a great tool that can provide support for many key eDiscovery tasks and CloudNine provides you with the ability to register online without any outside assistance and begin working with your data within five minutes. Registration.  No wait time, no project intermediaries, no process gates or hurdles. Simply register and upload your data directly into the CloudNine private, protected cloud environment and their automated processing will immediately begin to convert your documents into a searchable and reviewable format.

With a free trial period, free EDA, predictable pricing and web-based security, it is a great product and a great value.  Too great a value, in my estimation, to pass up. I highly recommend you log in and see for yourself.

Addendum

The Automated Law Firm was a comprehensive guide to law firm hardware and software first written by Dick Robbins in 1986. Dick had been the Director of the American Bar Association Technology Advisory Council ( the predecessor to the ABA Law Technology Resource Center ) before starting his own consulting firm, Law Office Automation Consultant. A good synopsis of the book can be found online.

I worked with Dick in the early 90’s and was asked by the publishers to co-author it when he became ill and then continue as sole author when he passed away in 1995. One of his features that I continued was a review of legal software programs.  The rating chart was based on 10 separate categories, all scored on a scale of 1 to 10. I used an updated version of that chart to compile the score below for CloudNine.

THE AUTOMATED LAW FIRM SOFTWARE RATING

  • Ease of Use: 10

CloudNine Automates eDiscovery Preservation and Collection

Cloud-based Offering Integrates and Automates Targeted Preservation and Collection Capability into the CloudNine eDiscovery Platform

CloudNine, a leader in simplifying and automating data and legal discovery for litigation, investigations, and audits, today announced the release of Targeted Preservation and Collection from CloudNine, an integrated and automated data discovery feature of the CloudNine eDiscovery Platform. This cloud-based capability simplifies and automates data preservation and collection for corporate legal and IT professionals and is available at no incremental cost as part of the CloudNine eDiscovery Platform.

“With the accelerating volume, variety, and velocity of electronically stored information (ESI), legal and IT professionals now more than ever require tools that can help streamline the complex eDiscovery phases of data preservation and collection,” shared Bill David, Chief Technology Officer of CloudNine. “With Targeted Preservation and Collection from CloudNine, users can now quickly detect, identify, locate, and collect ESI and have it automatically ingested and processed within a cloud-based, full-featured eDiscovery platform. This fully integrated capability short-circuits a previously laborious workflow typically done with multiple tools requiring multiple levels of human interaction and truly simplifies and automates preservation and collection.”

“Collection of ESI continues to be an extremely challenging phase of eDiscovery as it involves a need for direct data interaction coupled with the necessity of securely collecting and ultimately moving collected ESI into an eDiscovery platform for further evaluation,” highlighted Doug Austin, Vice President of Products and Services at CloudNine. “By automating the tedious and time-consuming tasks of finding and consolidating files and folders before collection and then automating the collection, ingestion, and processing phases of eDiscovery, CloudNine immediately and positively increases the effectiveness and economics of preservation and collection while removing risks associated with multiple instances of human intervention. Our customers have always asked for help in automating these critical first steps in the eDiscovery process, and we are delighted to be able to deliver them a targeted capability that can streamline their eDiscovery efforts, reduce their risk, and shorten the time to review in support of litigation, investigations, and audits.”

An Eight-Step Wizard Guided Selection Process

Available at no incremental cost as part of the CloudNine eDiscovery Platform, the automated preservation and collection capability is accomplished through an eight-step, wizard-driven selection process that includes:

1. A secure login to the CloudNine eDiscovery Platform
2. The selection of the files and folders to be collected (scanning of local drives or specific folders)
3. The selection of a processing option (host with CloudNine, host with Relativity, build early data analysis report, or automatically create a load file for a third-party eDiscovery platform)
4. The selection of the project for the collected data to be added to (creation of a new project or loading into an existing project)
5. The selection of the timezone for the collection
6. The naming of the collection (custodian, location, etc.)
7. The secure upload of the collection (compression and uploading)
8. The upload confirmation for the completion of processing for analytics and review

Upon completion of the preservation and collection process, users are automatically and immediately ready to begin using the analytics and review capabilities as determined by their processing option selection (CloudNine, Relativity, or Load File for export to additional platforms).
